These general conditions of sale were updated on February 1st, 2024.


  1. DEFINITION, PURPOSE, AND ACCEPTANCE OF THE GENERAL CONDITIONS

The Les Néréides site is an e-commerce site accessible via the Internet at the address www.lesnereides.com (hereinafter the “Site”). It is open to any user of this network. It is published by: NEREIDES DISTRIBUTION, simplified joint stock company registered in the Paris (France) Trade and Companies Register under number 400 260 386 (SIREN number), with VAT number FR 314 0026 0386, whose head office is at 3 rue Barbette 75 003 Paris, France and whose main place of activity is at 29 rue des Petites Ecuries 75 010 Paris, France (“Les Néréides”). The Site allows the company Les Néréides to offer for sale high fashion jewelry, perfumes, candles, and other accessories (hereinafter the “Product(s)”) to Internet users browsing the Site (after referred to as “Users”).


Orders placed on the Site are reserved for individuals for their personal needs. The resale of Néréides products purchased on the Site as part of a professional activity is strictly prohibited. The Site is not intended for minor children.


Any order for a Product offered on the Site requires consultation and express acceptance of these General Conditions of Sale, without however this acceptance being conditioned by a handwritten signature on the part of the User. Consultation of the Site by the User is also governed by the Conditions of use of the Site which he accepts without reservation and accessible here.


The General Conditions of Sale, the General Conditions of Use (https://uk.lesnereides.com/pages/legal-notice) and the order summary sent to the Client form a contractual whole and constitute the entirety of the contractual relations between the Parties.


It is specified that the User may save or print these General Conditions of Sale, provided however not to modify them.


Les Néréides reserves the right to modify these General and Specific Conditions of Sale at any time, without notice, it being understood that such modifications will not apply to reservations and orders previously accepted and confirmed by the Buyer. These conditions apply to the exclusion of the conditions applicable to sales in stores or through other distribution and marketing channels.


  1. AVAILABILITY and DESCRIPTION OF MARKETED PRODUCTS – ORDERING TERMS

The Site allows you to order a selection of Products from the Les Néréides and N2 by Les Néréides brands from the company Les Néréides, immediately online via the Internet from France.


Our Product offers and prices are valid as long as they are visible on the Site, while stocks last. Errors or modifications may exceptionally exist, particularly in the case of simultaneous orders for the same Product by several clientsd. In the event of product unavailability after placing your order, we will inform you by email or telephone as soon as possible, offering you either to order another Product presented on the Site as a replacement, or to cancel your order. If you choose to cancel your order, you will be refunded no later than 30 days from payment if your bank account has been debited.


Les Néréides incurs no liability in the event of out of stock or unavailability of Products.

Products ordered on the Site can be delivered worldwide, with the exception of the United States, Japan, Australia, New Zealand, and South Africa.


For each product selected on the Site, a summary page will be automatically displayed, including the photo of the item, its colors and references, the quantity chosen, its unit price and the total price of your order. You shall carefully check the accuracy of your selection before confirming your order. Upon confirmation, your order will be sent to Les Néréides for processing.


In accordance with the provisions of article L.111-1 of the Consumer Code, all efforts are made to ensure that the color and pattern of the Products whose photos are displayed on the Site are faithful to the original Products. Variations may occur, in particular due to technical limitations in color rendering on your computer equipment. Consequently, Les Néréides cannot be held responsible for errors or inaccuracies in the photographs or graphic representations of the Products appearing on the Site.

The online Gift Card


The Online Gift Card can only be ordered on the Site and can only be used on the Site.


The amount credited to the Online Gift Card, available thanks to the code, can be used online only via the Site, and can be spent in one or more installments.


The Online Gift Card is valid for 1 year, from the date of online purchase.


The Online Gift Card is not subject to VAT in accordance with articles 256 ter and 266 of the General Tax Code. The online order using the Gift Card as a means of payment will be subject to VAT, as determined by the regulations in force in the country to which the order is delivered and does not exclude possible shipping or customs costs.


The online Gift Card code shall be entered in the “Promo code” section when validating the basket, before finalizing the order. Once the code has been entered, the Client can choose to pay the remaining amount online to validate their order or use the exact amount on the Card.


The Online Gift Card is non-transferable, non-refundable, non-reloadable, it cannot be exchanged for cash, nor transferred to a credit card.


In the event of loss or theft, Les Néréides cannot be held responsible, and will not offer a refund or replacement. In the event of loss or theft, it is important to contact Customer Service as quickly as possible.


  1. ORDER VALIDATION

At the end of the order process, you are prompted to click on the "Pay" button. 

The Client shall check the box located in front of the message “I accept the general conditions of sale” to enter the payment details and definitively validate their order.


Your order can only be modified or canceled under the conditions expressly provided for in these General Conditions of Sale or under the conditions required by the law in force. Clicking to validate the order implies full acceptance of these terms. A summary of your order will be sent to you by email.


The data recorded by the Site constitutes proof of all transactions between Les Néréides and its Clients. In the event of a conflict between Les Néréides and one of its Clients over a transaction carried out on the Site, the data recorded by Les Néréides are considered irrefutable proof of the content of the transaction.


In application of article L. 213-1 of the Consumer Code, when an order concerns an amount equal to or greater than 120 Euros, Les Néréides keeps the writing which establishes the contract concluded between Les Néréides and a Client by electronically for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from this date (in accordance with decree 2005-137 of February 16, 2005). It is specified that the Client may have access to this document at any time upon simple request made to Les Néréides.


Les Néréides reserves the right to cancel any order from a Client with whom it is in dispute for a previous order, or if Les Néréides reasonably considers that this Client has violated these General Conditions or that he has engaged in fraudulent activity, or for any other legitimate reason.


  1. RESERVATION OF PROPERTY

The Products ordered remain the property of Les Néréides until full collection of the price by Les Néréides. In the event of a payment incident, you shall return the Products received to Les Néréides, from the first request, at your expense.


However, you assume the risks (in particular loss, theft or deterioration) concerning the Products delivered from the effective date of delivery.

 

  1. PRICE

All prices of the Products are indicated according to your geographical location and the currency you have chosen (your choice: Euros / Pound sterling / US Dollars / HK Dollars) all taxes included, excluding shipping or customs costs (see shipping and delivery paragraph).


The Products will be invoiced on the basis of the prices in force at the time of order registration.


The Site reserves the right to modify its prices at any time without notice or formality. These modifications will, however, have no impact on orders accepted by the Site before the entry into force of these modifications, subject to the availability of the Products ordered.


Any order placed on the Site shall be paid immediately after validation of your order.


All orders placed on the Site and whose country (or region) of delivery is outside mainland France may be subject to customs duties. These customs duties are imposed by the regulations in force in the country concerned. These taxes are your responsibility. If the recipient refuses customs duties or taxes, any sums requested and taxed from Les Néréides to recover the package will be deducted from the amount of your refund.


  1. PAYMENT

We only accept payments by bank card, credit card, Paypal account, Gift Card, payment in 3 installments with Alma or Klarna (United Kingdom). All orders are payable according to the terms chosen in article 5 hereof.


Accepted bank cards or credit cards are: CB®, MasterCard®, Visa®, Amex®.


Pay in installments with Alma or [Klarna (UK)]


Payment in three installments with Alma, or Klarna for the United Kingdom. If you pay for your order in three installments, you accept the general customer conditions of Alma and Klarna as well as the special conditions of Alma and Klarna for Clients of Les Néréides. Alma (or Klarna) is a telepayment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the civil code. Any termination of the T&Cs which bind Les Néréides and the Client, results in the termination of the T&Cs between Alma (or Klarna) and the Client.


If you pay by credit card which is perfectly secure: in this case, payment is made on the website of our partner Shopify Payments Payplug and/or Alma (France), Shopify Payments and/or Klarna (United Kingdom) and Shopify Payments (rest of world). This implies that no banking information concerning you passes through the Site. Your credit card details are encrypted using the [HTTPS and TLS] protocols and are never transmitted unencrypted over the network. Payment is made directly to the bank. We have no access to your bank details and do not keep them on the server, which is why you are asked for them each time you make a new transaction on the Site. We take advantage of this clause to inform you that our Site will never send you any communication, by email or other means of communication, to request communication of your bank details.


Your order will be recorded as soon as payment is accepted by the banking service. You can pay online with complete confidence by entering the number, expiry date of your bank card and the security code found on the back of your card in the spaces provided for this purpose.


Your order will only be shipped after verification of your payment method and receipt of debit authorization from your card. The Client guarantees that he has the necessary authorizations to use the payment method chosen at the time of validation of the order. If the bank refuses, the order will be automatically canceled, and the Client will be notified by sending an email.


  1. FIGHT AGAINST FRAUD

The Site reserves the right to check the validity of the payment, before shipping the order, by any means that Les Néréides deems necessary (in particular the request for identity documents, proof of address, etc.). Les Néréides also reserves the right to refuse to make a delivery or to honor an order from a Client who has not fully or partially paid a previous order or with whom a payment dispute is being administered. In the event of fraud or suspicion of fraud, Les Néréides reserves the right to remove any member without any notice or compensation.


  1. DELIVERY AREA - SHIPMENTS AND DELIVERIES

The Site ships orders within 48 hours to 72 hours from Monday to Friday. Orders placed on a Saturday, Sunday or public holiday will be processed the first following business day.


Sales and promotional periods may cause a slight additional delay.


Products ordered on the Site can be delivered worldwide (except in Japan, the United States, Australia, New Zealand and South Africa).


The Products are shipped to the delivery address you indicated during the ordering process. Les Néréides is in no way held responsible for an error in the delivery address provided or for the possible loss of your package by the carrier.

Delivery issues


Any defect or delay in delivery shakll be reported to our Customer Service as soon as possible. The Client shall check the good condition of the Products upon delivery. Any anomaly concerning delivery (damaged packages, missing items compared to the Site's invoice, late delivery, etc.) shall be the subject of reservations entered on the delivery receipt presented by the carrier.


You shall then contact Customer Service by email (contact@lesnereides.com) or by telephone (+ 33 (0)1 80 50 51 01). You can also reach us on WhatsApp (+33 (0)7 49 73 66 38). This makes it possible to improve the quality of service that can be offered and to allow Les Néréides to carry out an investigation with the carrier. 


In the event of non-conformity of the Products purchased or if they do not give you satisfaction, you can return them or request an exchange or refund under the conditions provided for in the section below "Returns - Refunds".

 

  1. RETURNS – REFUNDS

For hygiene reasons, earrings (excluding clips) are neither returned nor exchanged (unless the item has a defect). The same goes for perfumes and candles.

In other cases, within thirty (30) calendar days following the date of receipt of the Product purchased on our Site, and upon presentation of proof of purchase only, you have the option of returning the Product purchased on our Site:

  • for reimbursement. In the case of a refund request made within the framework of this right of withdrawal, the delivery costs invoiced by Les Néréides will be refunded in full if the order is returned in its entirety only.
  • to obtain a credit valid for a period of 12 months from the date of issue, on our Site but also in physical stores in France and the United Kingdom only (excluding corners and Outlets).

For any refund or exchange, the Client is invited to follow the return procedure accessible via the following link (https://web.baback.co/o?shop=les-nereides-n2-uk.myshopify.com).


The Products shall be returned under the following conditions: in their original condition, with the original labels and accompanied by the original packaging and the return slip. Les Néréides decide if the Products are, or not, in their initial state.

Under no circumstances will it be possible to make an exchange on our Site and the Site will not issue credits for use in a Les Néréides store.

Les Néréides will reimburse you within fourteen (14) days following receipt of the returned Products, by crediting your bank card or credit card.


For gifts - obtained on the Site - which have been offered to you, only the exchange is accepted upon presentation of an invoice. We will then provide you with an electronic credit note for the gift amount and you can place a new order.


Defective products

In the event that the return of the defective Product is well-founded, Les Néréides will proceed, at the Client's choice, or in the absence of a request from the Client, at Les Néréides' choice, initially with a refund or, where applicable, the issue of a voucher.

  1. LEGAL GUARANTEES

The Products sold on the Site are subject to the conditions of legal guarantees provided for by articles L 211-4, L 211-5 and L 211-12 of the Consumer Code as well as by articles 1641 and 1648 of the Civil Code.


  1. CONTRACTUAL GUARANTEE

All Néréides items (excluding fragrances and candles) purchased on the online store are guaranteed for one (1) year “parts and labor” from the date of purchase.


Handmade, the products are rigorously controlled. The gilding and enameling that complete our products are sensitive to shock, which is why Maison Les Néréides cannot guarantee you against damage they may suffer from improper use.


Les Néréides will, at the Client’s choice, or failing the Client's request, at the choice of Les Néréides, initially exchange it with an identical Product to the extent that this Product is available in stock or, where applicable, at the issuance of a credit note.


In order to increase the longevity of your jewelry and maintain its initial shine, we recommend that you take the greatest care of it (consult our care guide: https://uk.lesnereides.com/pages/care-instructions).


The guarantee does not apply to jewelry purchased in press sales, on a clearance site or on the site of one of our partners.



  1. REPAIR

At the end of the one-year warranty, if your item is repairable, we can provide you with a repair estimate. You can first send a photo of your item to our Customer Service via the email address contact@lesnereides.com who will transfer the request to our repair service and come back to you with the quote amount. No repairs will be carried out before acceptance and payment of the quote. You can then send your item to the following address under the aforementioned conditions:

Please attach to this shipment the address to which to send the item once the repair has been carried out as well as a contact email address and a telephone number. You also have the option of dropping off and/or collecting your repair directly at the address indicated above.


The costs of sending the products to be repaired are your responsibility, the costs of returning them to your address shall be at your expense.


  1. LIMITATION OF LIABILITY

Les Néréides is only bound by an obligation of means. The Client remains the sole judge of the appropriateness and adaptation to his/her needs and consumption of the products he orders.


Under no circumstances will Les Néréides be held liable for any indirect, incidental, special or incidental damage, and in particular, without limitation, operating loss, loss of profit or opportunity resulting from the purchase of Products on the Site, even if Les Néréides has been informed of the possibility of these damages.


Les Néréides cannot be held liable for use of the Products that does not comply with their intended purpose.


Les Néréides cannot be considered responsible for (i) the loss, alteration, or fraudulent access to the Client's personal data, (ii) the accidental transmission of viruses or other harmful elements, resulting access to the Internet or electronic mail transmissions.


Les Néréides does not guarantee that the Site is available continuously, without temporary interruption, without suspension or without error.


Without limiting the scope of the other provisions of the General Conditions of Sale, the liability of Les Néréides can only be retained in the event of proven fault being exclusively attributable to it. In any event, it will be limited to direct damage only.


Les Néréides reserves the right to suspend operation of the Site.


The Site may contain technical inaccuracies or other defects; Les Néréides does not guarantee the correction of these defects. The Site and the content of this Site are presented “as is” and “subject to availability”. The company Les Néréides expressly excludes any guarantee of any kind, express or implicit, and in particular, without this list being exhaustive, all implicit guarantees of conformity or appropriation of the Site or its content for a usual use or for a specific use, their quality or their absence of contravention of any provision.


  1. FORCE MAJEURE

Les Néréides cannot be held responsible for the total or partial non-performance of its obligations, if this non-performance is due to a fortuitous event or the occurrence of an element constituting force majeure such as in particular, and without this list is exhaustive, flood, fire, storm, lack of raw materials, transport strike, partial or total strike, or closure of the company during a strike. These events constitute a cause for suspension and/or extinction of the obligations of Les Néréides towards the Client, without compensation for the benefit of the Client.


  1. INTELLECTUAL PROPERTY

The intellectual property rights attached to the Products sold on the Site are and remain the exclusive property of Les Néréides. All exploitation rights are exclusively reserved to it. Under these conditions, no one is authorized to reproduce, exploit, distribute or use for any reason whatsoever, even partially, the intellectual property rights, without the prior written consent of Les Néréides. The Les Néréides’ brands are registered trademarks. Any reproduction therefore constitutes an infringement.


  1. APPLICABLE LAW – DISPUTES – MEDIATION

These General Conditions of Les Néréides are governed and interpreted in accordance with French law without taking into account the principles of conflicts of law. The Application of the United Nations Convention on Contracts for the International Sale of Goods is hereby expressly waived.


In the event of a dispute, the French courts have exclusive jurisdiction, and you acknowledge accepting their exclusive jurisdiction. Les Néréides reserves the right to request and obtain injunctions or orders for the defense of its rights hereunder. In the event of a dispute, and in accordance with the provisions of the Consumer Code concerning “the mediation process for consumer disputes”, you have the right to resort free of charge and before any legal action to the mediation service offered by Les Néréides (article L.612-1 of the Consumer Code).


This mediation procedure can only be triggered if Les Néréides Customer Service has not responded satisfactorily to your request. Mediation aims to seek and propose an amicable and personalized solution to conflicts between you and Les Néréides.
